User Agreement

This page is the agreement you check at Start. Starting, paying, texting us, or using this website means you agree. The Service we sell is a one-page website for $9.99 a month. Website only. Public Terms of Service. Your Site is not your lawyer. Questions about how to use the site: see FAQ, or text us after you start.

Who

You are dealing with Sunset Gaming LLC, a Texas limited liability company, doing business as Your Site (yoursite.site), and also as We Post It. Card statement: WE POST IT. Your Site is a DBA of Sunset Gaming LLC, not a separate company. These terms cover this website, texts, the shop file we keep, and the service. You must be 18 or older and able to bind the shop. This is a business service, not a consumer toy and not for children.

User policy

You will use the service only for a real shop you are allowed to represent. You will tell the truth. You will not send anything illegal, hateful, spam, malware, or a lie about the shop. This is for adult shop owners only. You will not fake reviews, rankings, or jobs. You will not try to break, scrape, or overload this site. You will not ask us to invent stones, jobs, prices, or words that are not yours.

A paid shop may make a Your Site login and change the page in the editor. There is no public customer dashboard beyond the shop page, the editor, and the login page. You may also text. We do the work. Shop name, ZIP, and phone start it. After that we may text for hours, towns, two looks (reply 1 or 2), and photos. We may copy hours, address, and category from Google once you finish Google. We never take a password. You stay owner of Google and Facebook. After Google says yes, you add us as Manager, not Owner.

We can refuse a shop, a photo, a post, a page change, or the whole service. We can take a post or a page down. We do not have to say why. We do not nag. A quiet week means nothing goes out.

Privacy

We collect what you give us to run the service:

Shop name, ZIP, and phone
Email, if you give one (that is where the receipt goes)
Photos and words you text
Hours, towns, looks, and other facts you tell us
That you paid, and the Stripe receipt. Stripe handles the card. We do not keep your full card number

We keep a shop file you never see (paid, Google, Facebook, website, photo pile). We use this to start and maintain Google, Facebook, and your website, to post photos you send, to text you about the service, and to keep records. We do not sell your name, phone, email, or photos. We do not sell a list of shops.

We may share what we must with people who help us run this (hosting, Stripe, phone or text tools) and if the law requires it. Google, Facebook, Apple, Bing, Stripe, and hosts have their own rules. That is them, not us.

You agree we may text the number you give about this service. Photos come by text. Reply STOP to stop service texts. Stopping texts does not by itself stop pay. To stop pay, you cancel. We may keep records the law or Stripe requires even after you stop.

This site may use a signed session cookie so you stay signed in, and local storage so the language button remembers English or Spanish. We do not run a tracking ad network on this page. See Cookies.

If you want something taken off a page we host, text us. We will take down what we control. We cannot erase copies already on Google, Facebook, or someone else’s phone.

Photos and words

You own your photos and words. You give Your Site a permission (a license) to put them on your website, Google, and Facebook, to keep them in the shop file, and to space a pile over time. That permission lasts as long as we need it to provide the service and the one-year hosted site. You say you have the right to send what you send, including people, graves, property, and logos in the picture. If you do not have that right, do not send it.

The first photo you text is your profile picture. It goes on Google, Facebook, and your page.

We do not invent captions. We use your words or only what is in the photo. If the picture and the words do not match, we hold. We do not promise a post will go up on a given day.

What we will do

For $9.99 a month, this is the service. If it is not written here, we do not owe it.

A website that is one page. Name, town, phone, hours if you give them, a photo if you send one, and a way to call. Not a store. Not extra pages. Not a blog.
We start a Facebook page from your shop name, town, and phone. You come in just to finish. You keep the login. You stay owner.
We post the photos you text us to Facebook, inside the caps below. One photo, one caption. Caption is your words, or only what is in the picture. The first photo you text is your profile picture. It goes on Google, Facebook, and your page.
Google is setup help only. We do not sell Google. We sit with you on your phone. We type. You finish. You keep the password. You stay owner. After Google says yes, you add us as Manager, not Owner. We do not create a Google listing as owner, and we do not take a password. If you already have Google, we may copy hours, address, and category from that Google listing.
After you start, we may put the same name, town, and phone on Apple Maps, Bing Places (from Google), a free Yelp claim, Nextdoor Business, and Foursquare. Once. No paid listings. No dump of extra sites. No rank promise.
If you send a pile of photos, we keep them and space them. Old photos are fine.
Need a change on the one page. Text us. We show two options when we can. Reply 1 or 2.
Instagram only if you ask. Then the same post caps as Facebook.
At most one ask for a Google review, and only after a real job.

We do not promise rankings, leads, calls, reviews, likes, or sales. We do not promise Google or Facebook will approve, verify, or keep a listing. We do not promise a post will be seen. Search and social change. That is outside us. We do not run paid ads for your shop in this price. We do not invent jobs, stones, prices, or captions. We do not fake reviews.

Limits (the caps)

Days and weeks are calendar days and weeks in America/Chicago (Central Time). A week is Monday 12:00 a.m. through Sunday 11:59 p.m. Central. These caps are the most we will do. They exist so the one page and the Facebook page cannot be spammed. We may do less. A quiet week means nothing goes out.

Website size. One page. $9.99 does not include a second page, a shop, a menu of pages, or a store.
Website updates. At most 3 (three) updates per calendar day on that one page. Update 4 and after that day wait until the next calendar day. That is only to stop spam. An update is a change you ask for: hours, phone, towns, words on the page, a photo on the page, a look (1 or 2), or taking a line off. We may do those three any time that day. We do not promise a clock time.
What does not use up an update. We take down something we refuse, something illegal, or a lie about the shop. That can happen any time and does not count as one of your three. Google or Facebook steps you do on your phone do not count as a site update.
Facebook posts. At most 1 (one) post per calendar day. At most 3 (three) posts per calendar week. Each post needs one photo. No photo, no post. If the picture and the words do not match, we hold. A duplicate dies. We do not have to post every day or every week.
Photos you send. You may send a pile. There is no daily cap on how many photos we will keep. Posting is still capped (1 a day, 3 a week). Photos we do not post that week stay in the pile. We do not promise we will post every photo you send.
Texts we start. We do not nag. At most 1 (one) service text we start per calendar day, unless you just texted us, in which case we may reply. Reply STOP to stop service texts. STOP does not cancel pay. To stop pay, you cancel.
Google. Setup help only. Not a daily product. We do not sell Google updates by the day. We do not promise a second sit-down.
Findability listings (Apple Maps, Bing, Yelp free claim, Nextdoor, Foursquare). We may do each once after you start. Not every day. Not a rank service.
Review ask. At most one Google review ask, and only after a real job. Not daily.
First posts. We may hold the first public posts until we approve them. After that, the caps above still apply.
We can always say no. We can refuse a shop, a photo, a post, a page change, or the whole service. We can take a post or the page down. We do not have to say why.

If you ask for more than a cap allows, the extra waits until the next day or the next week. We will not do more than the cap to “catch up.” That is the limit.

Referral

Only an already-paying shop can refer another shop. A shop that has not paid, or that stopped paying, cannot earn a referral free month. You text us the new shop's name and phone. There is no portal. There is no referral dashboard. There are no unique referral codes or links.

The new shop must pay $9.99 before you get the referral free month. The referral free month is one skipped billing. If the new shop is refunded, that credit is pulled from the referring shop. The new shop does not get a free month for being referred. Referral free months stack with no cap. Three paid referrals equals three skipped billings.

Pay, cancel, year

$9.99 a month unless we tell you a shop is free. Stop whenever. Pay once and the website we host stays up for twelve (12) months from your first successful payment, even if you cancel the monthly service. After that year we may take the site down. Facebook and Google stay yours. Refunds are not required. If we refund, that is our choice. Starting means you agree to this page.

If a charge fails, we may pause work until it is fixed. The one-year hosted site still counts from the first successful payment.

Protection

Google, Facebook, Apple, Bing, Stripe, phone companies, and hosts are not us. We are not them. If they change, break, delay, ban, or say no, that is them. We are not liable for them.

THE SERVICE, THIS WEBSITE, TEXTS, POSTS, AND ANY PAGE WE HOST ARE PROVIDED AS IS AND AS AVAILABLE. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANYTHING WILL BE UNINTERRUPTED, SECURE, ERROR FREE, OR THAT YOU WILL GET BUSINESS FROM IT. YOU USE IT AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT TEXAS LAW ALLOWS, WE POST IT AND ITS OWNERS, MEMBERS, WORKERS, CONTRACTORS, AND AGENTS ARE NOT LIABLE FOR ANY CLAIM, LOSS, COST, INJURY, OR DAMAGE OF ANY KIND, IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING LOST PROFITS, LOST DATA, LOST BUSINESS, REPUTATION, RANKINGS, REVIEWS, LEADS, GOODWILL, INCIDENTAL, SPECIAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN. THIS INCLUDES CLAIMS ABOUT PHOTOS, POSTS, WEBSITES, GOOGLE, FACEBOOK, TEXTS, PAYMENT, OR THIS PAGE. IF A COURT SAYS WE OWE YOU MONEY ANYWAY, THE MOST WE OWE IN TOTAL IS THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $9.99, WHICHEVER IS MORE. YOU WILL NOT SUE US FOR ANYTHING ELSE. YOU WAIVE CLAIMS TO THE MAXIMUM EXTENT TEXAS LAW ALLOWS, INCLUDING WHERE A STATUTE WOULD OTHERWISE GIVE YOU MORE, TO THE EXTENT THAT WAIVER IS ALLOWED.

You cover us

If someone comes after us because of your shop, your photos, your words, your customers, your Google or Facebook, a listing, a post, or your use of the service, you will defend us, pay our costs (including Texas lawyers), and pay any award or settlement. You do that even if you stop the service.

Texas

Texas law governs, without regard to conflict-of-law rules. Exclusive venue is in the state courts of Texas. You and we waive a jury trial to the extent Texas law allows. You must bring any claim within one (1) year after it first could have been brought, or it is gone, to the extent Texas law allows. No class actions, no class arbitration, no representative actions. If one line here cannot be used, the rest still stands. This page, the Terms of Service, the Privacy Policy, and the Cookie Notice are the written terms. If this page and the Terms of Service disagree on price, what we will do, caps, pay, or cancel, this page controls. No other promise counts.

This is a business-to-business service. If a court says consumer law applies anyway, including any Texas consumer statute, our liability is still limited as far as that law allows. Nothing on this page or in a text is legal advice. We do not explain this page. Read it yourself or get your own lawyer.

We may change this page. The date at the top is the date it was last set. Using the site, texting us, or staying a shop after a change means you agree to the new page.
