Terms of Service

These Terms of Service ("Terms") are the public terms for using Your Site. They cover www.yoursite.site, shop pages we host on yoursite.site, logins, texts about the service, and the one-page website we build and host (together, the "Service").
The Service is operated by Sunset Gaming LLC, a Texas limited liability company doing business as Your Site and also as We Post It ("Your Site," "we," "us," or "our"). Card statement: WE POST IT. Your Site is a DBA of Sunset Gaming LLC, not a separate company.
By visiting this website, opening a shop page, making a login, texting us, starting, or paying, you agree to these Terms, the Privacy Policy, and, when you start the paid Service, the User Agreement. If you do not agree, do not use the Service.
The Terms of Use cover browsing the marketing website. These Terms of Service are the complete public terms for the Service. If you start by checking the agreement box, the User Agreement also binds you. If the User Agreement and these Terms disagree on price, what we will do, caps, pay, or cancel for a paid shop, the User Agreement controls those points. These Terms control everything else about using the Service.
1. Agreement
Read these Terms. They include automatic monthly billing, "as is" disclaimers, a cap on what we can owe you, a Texas court requirement, a jury waiver, a class-action waiver, and a one-year time limit to bring a claim, to the extent Texas law allows.
If you use the Service for a shop, you agree for that shop, and you say you can bind it. "You" means you and that shop.
2. Who we are
Sunset Gaming LLC is a Texas limited liability company. Principal place of business: Texas, United States. We are not Google, Meta, Apple, Stripe, or your lawyer. We do not give legal advice. Questions about how to use the site: see the FAQ or text us after you start.
3. The Service
Your Site is a website service. For $9.99 a month we:
- Build and host one page for your shop. Typical contents: shop name, town or ZIP, phone, hours if you give them, photos you send, and a way to call. Address:
{shop}.yoursite.site. - Put on that page the facts you give us, or public listing facts we may copy so you do not retype them.
- Update that page when you text or upload a change, subject to the caps in the User Agreement.
- Let a paid shop make a login and change the page in the editor we provide.
The Service is not a store, a blog, extra pages, email hosting, paid ads, ranking, lead generation, or a promise of calls or sales. We do not sell Facebook page management or Google Business Profile management as the Service. Website only.
If it is not written in these Terms or the User Agreement, we do not owe it. We do not promise Google, Facebook, Apple, Bing, or anyone else will list you, verify you, or keep a listing.
4. Who may use it
The Service is for shop owners and people they authorize, age 18 or older, who can bind the shop. This is a business-to-business service, not a consumer product and not for personal, family, or household use. It is not for children. We do not knowingly collect information from anyone under 18.
You say the shop is real, the name and phone are true, and you are allowed to put that shop online.
5. Login and security
You may make a Your Site login (email or username and password, or Sign in with Google). Google sign-in is identity only. We do not get your Google password. We never take a Google, Facebook, or hosting password from you.
You are responsible for the login, the phone you give us, and anyone who uses them. Keep passwords to yourself. Tell us if you think the login was stolen. We may close a login that is abused or unused.
There is no public customer dashboard beyond the shop page, the editor for a paid shop, and the login page.
6. Your content
You own your photos, words, hours, and shop facts ("Your Content"). You grant Your Site a non-exclusive license to host, copy, display, and adapt Your Content as needed to run the Service, including on the shop page and in backups, for as long as we host the page (including the twelve-month hosted period after first successful payment). We may compress or crop a photo so it fits the page.
You say you have the right to send what you send, including people, property, logos, and graves in a picture. If you do not have that right, do not send it. The first photo you text or set as the main photo is the main picture on the page.
We may refuse or take down a photo or line that is illegal, hateful, sexual involving minors, spam, malware, a lie about the shop, or someone else's property. We do not have to explain.
Shop pages are public. Anyone on the internet can open them. You are responsible for what the public sees.
7. Acceptable use
You agree not to:
- Use the Service for anything illegal, or to help a crime.
- Send malware, scrape this website without permission, overload our systems, or break into accounts.
- Impersonate Your Site, another shop, or a person.
- Ask us to invent jobs, prices, reviews, rankings, or services you do not offer.
- Post or ask us to post content that is obscene, hateful, defamatory, or that infringes copyright, trademark, or privacy.
- Use the shop page to spam, phish, or mislead the public.
- Resell the Service as if it were yours, or copy our design to compete with us.
We may refuse a shop, a photo, an edit, or the whole Service, with or without notice.
8. Shop pages and visitors
The shop page is yours to the public. Their calls, visits, and any work you do for them are between you and them. We are not a party to those jobs. We do not take bookings or payments for your customers on the $9.99 page.
If the law requires a privacy notice on your shop page for your own visitors, that is your job. Our Privacy Policy explains what we collect to run Your Site.
We may put a small Your Site credit or "Keep this site" link on a page we host. Paid shops follow Keep and billing as written in the User Agreement.
9. Our property and feedback
The Your Site name, layout, software, stock images we supply, and this marketing website are ours or licensed to us. These Terms do not give you those rights except to use the Service as allowed.
If you send feedback, we may use it with no payment to you.
10. Fees, renewals, and cancel
The Service is $9.99 per month unless we tell a shop it is free. Stripe processes the card. By starting, you authorize recurring monthly charges until you cancel. We do not keep your full card number.
Fees are not refundable. If we refund once, that does not mean we will refund again.
Cancel any time by texting us. Cancel stops future months. It does not refund months already paid. After you pay once, the one-page site we host stays up for twelve (12) months from the first successful payment, even if you cancel the monthly Service. After that year we may take the page down.
If a charge fails, we may pause edits and new photos until it is fixed. The twelve-month clock still starts at the first successful payment.
Taxes, if any, are extra if the law requires them.
11. Third parties
We use other companies to run the Service, including hosting, file storage, Stripe, and, if you use it, Google sign-in. Those companies have their own terms. We are not them. If they delay, break, change price, or refuse, that is them.
Links on a shop page (maps, call links, social URLs you give us) go to third-party sites. You use those at your own risk.
12. Copyright complaints
If you believe a shop page we host infringes your copyright, send a notice that meets 17 U.S.C. § 512 to us through the Contact page, with: your signature, the work, the URL of the page, your address and phone, a good-faith statement, and a statement under penalty of perjury that you are the owner or agent. We may take the material down and tell the shop. Repeat infringement can end the Service.
Counter-notices: the shop may send a counter-notice as the statute allows. We may restore the material if we do not hear that you filed a court action.
13. Changes to the Service
We may change or stop parts of the Service. We may change eligibility. We may move a shop URL if we must. We will not raise the $9.99 price in these Terms without updating this page; staying a shop after an update means you agree to the new page.
14. Disclaimers
THE SERVICE, THIS WEBSITE, TEXTS, LOGINS, AND EVERY PAGE WE HOST ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANYTHING WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE, OR THAT YOU WILL GET BUSINESS, CALLS, RANKINGS, OR REVIEWS FROM IT. YOU USE IT AT YOUR OWN RISK.
15. Limitation of liability
TO THE MAXIMUM EXTENT TEXAS LAW ALLOWS, SUNSET GAMING LLC, YOUR SITE, WE POST IT, AND THEIR OWNERS, MEMBERS, WORKERS, CONTRACTORS, AND AGENTS ARE NOT LIABLE FOR ANY CLAIM, LOSS, COST, INJURY, OR DAMAGE OF ANY KIND, IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING LOST PROFITS, LOST DATA, LOST BUSINESS, REPUTATION, RANKINGS, REVIEWS, LEADS, GOODWILL, INCIDENTAL, SPECIAL, INDIRECT, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN. THIS INCLUDES CLAIMS ABOUT PHOTOS, PAGES, TEXTS, LOGIN, PAYMENT, OR THIS WEBSITE.
IF A COURT SAYS WE OWE YOU MONEY ANYWAY, THE MOST WE OWE IN TOTAL IS THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $9.99, WHICHEVER IS MORE. YOU WAIVE OTHER CLAIMS TO THE MAXIMUM EXTENT TEXAS LAW ALLOWS.
Some places do not allow some limits. There, we limit as far as that law allows. This is a business-to-business service. If a court says consumer law applies anyway, our liability is still limited as far as that law allows.
16. You cover us
If someone comes after us because of your shop, Your Content, your customers, your page, a listing you asked for, or your use of the Service, you will defend us, pay our costs (including Texas lawyers), and pay any award or settlement. That continues after you cancel.
17. Suspension and end
We may suspend or end the Service, a login, or a shop page if you break these Terms, if a charge fails, if the law requires it, or if we stop offering the Service. You may end by canceling as in Section 10. Sections that should survive (pay already due, license for hosted months, disclaimers, liability cap, indemnity, Texas) survive.
18. Texas law and disputes
Texas law governs these Terms, without regard to conflict-of-law rules. Exclusive venue is the state courts of Texas. You consent to those courts.
To the extent Texas law allows, you and we waive a jury trial. Any case is individual only. No class actions, class arbitration, or representative actions.
You must bring any claim within one (1) year after it first could have been brought, or it is gone, to the extent Texas law allows.
If one line cannot be used, the rest still stands. We may assign these Terms (for example if the company is sold). You may not assign without our written OK, except to someone who buys your shop and takes over the page, if we agree in writing.
19. Entire agreement
These Terms, the Privacy Policy, the Cookie Notice, and (when you start) the User Agreement are the agreement for the Service. No side promise counts unless it is written on those pages. The Legal Notice says who operates the site.
We may update these Terms. The date at the top is the last update. Using the site, texting us, or staying a shop after a change means you agree to the new Terms. If you do not agree, stop using the Service and cancel.
